Overview

These terms apply to your use of Aquatell's websites, aquatell.com (our US store) and aquatell.ca (our Canadian store), to Aqua, our AI water specialist, and to the orders you place with us. In these terms, "Aquatell", "we", "us" and "our" mean Aquatell Inc. and the businesses it operates as Aquatell U.S. and Aquatell Canada; "you" means the person using our stores or services.

By using our stores, talking to Aqua or placing an order, you agree to these terms and to the policies they mention: our privacy policy, our shipping policy and our returns and warranty policy. If you don't agree, please don't use our stores.

You must be at least the age of majority where you live to place an order, or have your parent or guardian's permission.

Our two stores

Our US store sells in US dollars and ships within the United States. Our Canadian store sells in Canadian dollars and ships within Canada. Each store's prices, shipping charges and taxes apply to orders placed in it. You can switch stores at the top of any page. An order is with Aquatell U.S. if placed in the US store and with Aquatell Canada if placed in the Canadian store.

Orders, prices and payment

• Prices are shown in the store's currency and don't include tax. Shipping and tax are added at checkout, where you see the full total before you pay.
• Payment is taken by Stripe, our payment provider, on its secure checkout page. Your order is confirmed once payment succeeds; we'll email you a confirmation.
• We can change prices, products and offers at any time, but not for an order you've already placed and paid for.
• We may refuse or cancel an order, or limit quantities, for example if a product is out of stock, a price or description is wrong, we suspect fraud, or shipping to your address would cost far more than usual. If we cancel an order you've paid for, we refund you in full.
• Please give us accurate contact, shipping and billing details and keep them up to date. We're not responsible for orders delayed or lost because of an incorrect address.

Products and information

We try to describe our products, their specifications, prices and availability accurately, and to keep our articles and water research current. Even so, information on our stores may contain errors or be out of date, and product photos may not match exactly what you receive. We may correct errors and update information at any time without notice, including after you've placed an order (in which case we'll contact you before going ahead).

Our water research (hardness, disinfectant and fluoride by city) comes from public sources such as utility water quality reports. Water changes over time and from home to home, so it's a guide, not a test of your water.

Aqua, our AI water specialist

Aqua is an artificial intelligence assistant that answers questions about water treatment, our products and your orders, on our website, by text and by phone.

• Aqua's answers are general information, not professional, medical or legal advice. Aqua can be wrong, misunderstand you or rely on information that's out of date. Check important details with one of our water specialists before you rely on them.
• Aqua can't tell you whether your water is safe to drink. Only a certified laboratory test of your water can. If you're on a well, or have health concerns, have your water tested.
• Aqua can add items to your cart and show you products, but it can't take payment, give discounts or change an order's price. Anything Aqua says that conflicts with these terms, our policies or the price at checkout doesn't bind us.
• Don't use Aqua for anything unlawful, to try to make it misbehave, or to share other people's personal information, payment card numbers or sensitive health information.
• Your conversations with Aqua are handled as our privacy policy describes.

Installation and use of equipment

Water treatment equipment should be installed and maintained following the manufacturer's instructions and local plumbing and electrical codes. Our installation guides and our team's advice are offered to help, but you're responsible for how your equipment is installed and used, or for hiring a qualified professional to install it. Follow the maintenance schedule for filters, lamps, resin and other parts: equipment that isn't maintained may not treat your water.

Shipping, returns and warranty

How we ship, what it costs and when it arrives are in our shipping policy. Returns, refunds, restocking fees and product warranties are in our returns and warranty policy. Manufacturers' warranties are provided by the manufacturer under its own terms. Nothing in these terms limits any rights you have under consumer protection laws that can't be excluded.

Your account

You're responsible for keeping your password and sign-in links private and for what happens in your account. Tell us right away if you think someone else has used it. We may suspend or close an account that's used in breach of these terms.

Things you send us

If you send us comments, reviews, ideas, photos or other material, you confirm you have the right to share it and you let us use it to provide and improve our services. Don't send material that is unlawful, misleading, infringes anyone's rights or contains malicious code. We may remove anything we consider inappropriate.

Other websites

Our stores may link to other websites, such as manufacturers' manuals or water utilities' reports. We don't control them and aren't responsible for their content, products or privacy practices.

Prohibited uses

You may not use our stores, Aqua or their content: for any unlawful purpose; to infringe our intellectual property or anyone else's; to harass, abuse, defame or discriminate against anyone; to submit false or misleading information; to upload or transmit viruses or other malicious code; to collect or track other people's personal information; to spam, phish, scrape or crawl our sites or services, or to overload them; or to interfere with or get around their security. We may end your access for violating these rules.

Intellectual property

The content of our stores, including text, articles, research compilations, photos, graphics and our trademarks, belongs to us or to those who license it to us. You may view and print it for your own personal use, but not copy, republish or use it commercially without our written permission.

Disclaimer and limitation of liability

We don't promise that our stores or Aqua will always be available, uninterrupted, secure or error-free, or that the results of using them will be accurate or reliable. We may suspend or withdraw them at any time.

Except as expressly stated by us or by a product's warranty, our stores, Aqua, and the products and services we provide through them are provided "as is" and "as available", without any representation, warranty or condition of any kind, express or implied, including implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title and non-infringement.

To the fullest extent the law allows, Aquatell and our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers and licensors aren't liable for any indirect, incidental, punitive, special or consequential damages, or for lost profits, revenue, savings or data, arising from your use of our stores, Aqua or any product, even if we were told they were possible. Where our liability can't be excluded, it is limited to the amount you paid for the product or service concerned. Some states and provinces don't allow these exclusions or limits, so some of them may not apply to you.

Indemnity

You agree to indemnify and hold harmless Aquatell and our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers and licensors from any claim or demand, including reasonable legal fees, made by a third party because of your breach of these terms or your violation of any law or anyone else's rights.

General

• If any part of these terms is found unenforceable, the rest still applies.
• If we don't enforce a right under these terms, we haven't waived it.
• These terms and the policies they mention are the whole agreement between you and us about using our stores, and replace any earlier version.
• Orders from our US store are governed by the laws of the State of Florida and the United States; orders from our Canadian store by the laws of the Province of Ontario and the federal laws of Canada that apply there. This doesn't take away any protection you have under the consumer laws of the place where you live.

Changes to these terms

We may update these terms from time to time. We'll post the new version here with its date. Changes don't apply to orders placed before the new version was posted.
